Terms of Use
All information and intellectual property pertaining to our services and on any of our web sites are protected by international copyright laws. The word(s) "SHARE YOUR NOGGIN", the word "CALCBASE", the word "PODDIN" and the word "GEOMETRIA" are either trademarks or registered trademarks of Geometria Research and Design Inc in various countries, and are therefore protected by trademark laws in these jurisdictions. In addition, when you use any of our services or enter any of our web sites, you are bound by the following agreement:
1 Bound by usage. Geometria Services and all Geometria web sites, including share your noggin, are supplied to you by Geometria Research and Design Inc ("Geometria") in consideration of your agreement to the following terms, and your use of Geometria Services and any Geometria web site constitutes acceptance of these terms.
2 No Warranty. You understand that all information or other materials provided to you by Geometria is supplied "AS IS" without warranty of any kind as to its accuracy or completeness. To the extent that Geometria makes available services or information regarding services, you understand that Geometria is under no obligation to provide updates, enhancements, or corrections, or to notify you of any changes to services that Geometria may make. GEOMETRIA DOES NOT GUARANTEE RESULTS OR IDENTIFICATION OR CORRECTION OF PROBLEMS. GEOMETRIA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO THE SERVICES, OR OTHER MATERIALS PROVIDED.
3 Support. All support inquiries and responses shall be made in accordance with any instructions provided by Geometria. Geometria makes no guarantees with respect to response time or resolution of the issue.
4 Terms. You understand that Geometria reserves the right to modify the terms and conditions of its services at any time without notice, and to disallow the use of its services for any activity that Geometria deems to be unacceptable, and to revoke your participation in such services at any time. No refund or partial refund of any fee will be made for any reason.
5 Consequential Damages. IN NO EVENT SHALL GEOMETRIA BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES; LOSS OF USE, DATA, PROFITS OR GOODWILL; OR BUSINESS INTERRUPTION) ARISING IN ANY WAY OUT OF THE USE OF GEOMETRIA SERVICES, HOWEVER CAUSED AND WHETHER UNDER THEORY OF CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, EVEN IF GEOMETRIA HAS BEEN ADVISED OR IS AWARE OF THE POSSIBILITY OF SUCH DAMAGE.
6 Complete Agreement. This Agreement constitutes the entire agreement between the parties and supersedes all prior or contemporaneous understandings regarding such subject matter. No addition to or removal or modification of any of the provisions of this Agreement will be binding upon Geometria unless made in writing and signed by an authorized representative of Geometria.
7 Effective Date. The "terms of use" set out above is effective as of March 01, 2009, supersedes all previous "terms of use", and applies to all services operated by Geometria Research and Design Inc. We reserve the right to change the terms of use at our sole discretion. Each user of our web sites and services will be informed of any such change on their next sign in to our servers.
Privacy Policy
1. Geometria Research and Design Inc. takes your right to privacy very seriously. Access to all of our web sites and services is password protected as required, all communication that needs to be secure uses secure socket layer (SSL) technology, and all data storage is encrypted using state of art algorithms.
2. To provide you with our services, we do need to collect personal information from you and record general information pertaining to your usage of our services. For instance, to allow you to sign in to your account, and to keep your account secure, we must collect some personal information about your identity. For security and quality control purposes, we must log non-personally identifiable information about all clients that connect to our servers. For user convenience, we may make use of software technologies such as unique identifiers or "cookies." Cookies are small text files that we place in visitors' computer browsers to store their preferences. Clients can choose to have their computer warn them each time a cookie is being sent, or can choose to turn off all cookies. Some of our services use information about our clients and their locations to provide them with web links to information and ideas that should be of interest to them.
3. We also collect information for market research purposes. This allows us to obtain feedback and gain a better understanding of our clients so that we can provide a more valuable service.
4. Our services are characterized by a strong "sharing with others" component. For instance, "shareyournoggin" allows clients to share their ideas with others across the Internet. It is the responsibility of our clients to use good judgement when sharing their information, profile description and ideas with others.
5. Our web sites often include separate spaces for tweens and for persons over twelve years old. All users must comply with our age sensitive rating system. Without our permission, tweens may not access a thirteen plus account and users over fourteen years old may not access a tween account. The only information we collect from a tween is a last name, a first name, a date of birth, a user name, a password, a secret word, an email address and a short profile. All tween accounts are commercial free.
6. Our web sites do not collect or store any personal financial information and all financial transactions are directed to reputable third party providers.
7. We may disclose information where we are required to do so by law, for example, in response to a court order or a subpoena, or where we disclose information to service providers or other group companies who provide support for the operations of our web sites or services and who do not use or disclose the information for any other purpose. To the extent permitted by applicable law, we also may disclose personal identity information in response to a law enforcement agency's or other public agency's (including schools or children services) request or if we feel that such disclosure may prevent the instigation of a crime, facilitate an investigation related to public safety or protect the safety of a child using our web sites or services, protect the security or integrity of our web sites or services, or enable us to take precautions against liability.
8. If we sell all or part of our business or make a sale or transfer of our assets or are otherwise involved in a merger or business transfer, we may transfer personal identity information to a third party as part of that transaction, to the extent permitted by applicable law.
